Terms of Service

1. Scope & provider
These terms govern your use of Speaka, operated by NEXT DATA CONSULTING (ABN 41 448 410 750), 68 Ridge St, Merewether NSW 2291, Australia (“we”, “us”). By registering you accept these terms. See also our legal notice and privacy policy.
2. The service
Speaka is a web app for practising spoken conversation in foreign languages. An AI conversation partner (via Google’s Gemini API) plays scenario-based roles; the app shows transcripts, gives feedback and stores your progress. We don’t guarantee uninterrupted availability, and the feature set may change.
3. Account & minimum age
An account is required. You must be at least 16 years old; younger learners need the consent of a parent or guardian. You are responsible for keeping your credentials confidential and for the accuracy of the details you register with.
4. Acceptable use
You agree not to misuse the service — in particular:
- not to submit unlawful, abusive or rights-infringing content;
- not to circumvent security measures or overload the service with automated traffic;
- to use the service for personal, non-commercial language practice only.
5. AI-generated content
Your conversation partner in the scenes is an AI system, not a human — even when it plays a human role within the role-play. The AI partner’s replies and the correction/feedback suggestions are machine-generated and can be wrong or inappropriate. They are not binding linguistic, legal, medical or other advice. Verify important information yourself.
6. Paid subscriptions, prices & cancellation
The basic features are free with a daily limit. Additional features are offered as a subscription (monthly or yearly); the applicable prices — including local currency and taxes — are shown on the pricing page before you buy.
Each plan includes a set number of practice conversations per day, and each conversation lasts up to five minutes — enough for a focused speaking session; the call ends automatically after that. We may adjust these technical limits within reason to keep the service fast and affordable for everyone; the number of daily conversations you have paid for will not be reduced during a period you have already paid for.
Sales and payment are handled by our reseller and merchant of record, Polar (Polar Software, Inc., Dover, Delaware, USA). Your purchase contract is with Polar, and Polar’s Buyer Terms additionally apply.
Every subscription starts with a 3-day free trial; the first payment happens only after the trial ends. Subscriptions renew automatically for the chosen period until cancelled. You can cancel at any time with effect from the end of the period already paid for — in Settings or via the link in any Polar receipt.

7. Consumer rights & liability
Australian consumers: our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that cannot lawfully be excluded. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited (at our election) to resupplying the service or paying the cost of having it resupplied.
Mandatory consumer rights under the law of your country of residence — for example EU consumer law or the UK Consumer Rights Act 2015 — likewise remain unaffected.
Subject to the above, and to the extent permitted by law: we provide the service with reasonable care and skill but are not liable for indirect or consequential loss, and our total liability arising out of the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence.
8. Termination
You can delete your account at any time in Settings. We may suspend access in the event of serious breaches of these terms.
9. Changes
We may amend these terms when the service or the legal situation changes. We will announce material changes in an appropriate way; the version published here applies.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state. If you are a consumer resident elsewhere, this choice does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, and you may also bring proceedings there. Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
